Add Real Christmas Cheer: Precision, Productivity, and the Tools Lawyers Deserve

December tends to make lawyers reflective. Court calendars quiet down, inboxes slow just enough to allow thinking, and the year’s accumulated frustrations come into view: the documents that took too long, the numbering that fell apart at the worst time, the tools that promised much and delivered little.

In 2025, the profession confronted a deeper issue: precision is not optional.

Courts issued sanctions for fabricated citations. Judges warned that AI tools were “scheming” to hide mistakes. Lawyers discovered that convenience often comes with invisible risks — especially when cloud tools handle confidential material or generate language without oversight.

Yet the real story of 2025 isn’t about technology gone wrong. It’s about the quiet, powerful ways legal professionals reclaimed control over their documents.

1. Precision Is the New Professional Margin

Across thousands of firms worldwide, one theme dominated: the cost of imprecision is rising. When AI produces text with confidence but not accuracy, lawyers must verify everything. When cloud systems require the upload of confidential client data, privilege suddenly becomes negotiable.

What lawyers want, and what the market increasingly demands, is predictability — tools that do the same thing every time, tools that never improvise, tools that never learn from your private files, and tools that never leak.

That’s why offline, rule-based automation made a resurgence this year. Firms discovered that the safest systems were also the fastest.

2. The Hidden Cost of Word Workarounds

We tallied results from millions of automated words this year. The same patterns appeared everywhere:

  • Hours lost fixing captions.

  • Hours lost repairing broken Word numbering.

  • Hours lost patching reused documents.

These costs accumulate quietly. No single moment seems catastrophic, but the cut-and-paste tax is real — and for many firms it totals dozens of hours a month.

Snapnumbers™ users often tell us they adopted it for one document and realized they’d been losing time in every document for years. PRO and Doxserá® users say something similar: they automate one agreement, then a second, then a dozen, then hundreds.

Document automation isn’t just a productivity increase; it’s a quality increase. Lawyers produce more consistent work when the structure is right before they begin.

3. What the Highest-Performing Firms Have in Common

The firms that made the largest leap in 2025 did not necessarily automate the most. They automated the right things:

  • Captions that adjust themselves.

  • Parties that switch roles automatically.

  • Logic that determines which clauses appear.

  • Structured templates that prevent errors before they occur.

These systems don’t make drafting faster only; they make drafting better.

4. The Gift of a Document That Behaves Itself

Here’s where the Christmas cheer comes in.

Law firms don’t need more holiday platitudes. They need relief. They need fewer frustrating hours. They need documents that stay in line.

Snapnumbers is one of the smallest but most delightful fixes in the profession. It removes a daily irritation — perhaps the most common irritation — for anyone who touches Microsoft Word. And once numbering behaves, everything else gets calmer.

If you want to give your team (or yourself) something meaningful this season, give them stability.

5. Looking Toward 2026

The legal landscape will continue evolving, but two things will remain true:

  • Clients expect flawless work.

  • Lawyers must protect confidentiality and privilege with absolute rigor.

Tools that respect those principles — offline, predictable, controlled by the author, in other words rule-based automation — will define the next decade of legal technology.

If 2025 was the year precision returned to the law, then 2026 can be the year it becomes permanent.

Legal Privilege, Cloud AI and the Ethics Gap in Document Automation

Generative AI tools like ChatGPT are increasingly being used by legal professionals for drafting, brainstorming, and research. An increasing number of document automation vendors in the legal industry are integrating generative AI or cloud-based services into their offerings. But these tools are not confidential—and their use poses a serious risk to attorney-client privilege, regulatory compliance, and ethical obligations. Recent developments indicate serious trouble may lie ahead.

It’s time for lawyers, law firms, bar associations, and anyone handling confidential data—or subject to CCPA, HIPAA, or GDPR—to look beyond hardware and encryption and ask the foundational question: once data is shared with the cloud, who really owns and controls it?

Executive Summary

What OpenAI’s
Sam Altman Said

“People talk about the most personal sh** in their lives to ChatGPT. […] And right now, if you talk to a therapist or a lawyer or a doctor about those problems, there’s legal privilege for it. […] We haven’t figured that out yet for when you talk to ChatGPT.”

Recent revelations by OpenAI CEO Sam Altman and a federal court order requiring the indefinite retention of ChatGPT user logs have made one fact unavoidable: cloud-based AI tools do not offer legal privilege or confidentiality protection.

This concern extends beyond general-purpose tools like ChatGPT. An increasing number of document automation vendors in the legal industry are integrating generative AI or cloud-based services into their offerings. While marketed as productivity boosters, these features often come at the cost of diminished confidentiality and uncertain privilege protections.

This white paper explains the implications of this gap for lawyers, regulators, and the public, and it presents a viable alternative: secure, offline document automation that keeps sensitive data fully under user control. It concludes with concrete recommendations for Bar associations and ethics committees to protect privilege in the age of AI.

What Sam Altman Just Admitted

In July 2025, OpenAI CEO Sam Altman made headlines with a candid acknowledgment:

“People talk about the most personal sh** in their lives to ChatGPT. […] And right now, if you talk to a therapist or a lawyer or a doctor about those problems, there’s legal privilege for it. […] We haven’t figured that out yet for when you talk to ChatGPT.”

This was not a leak or legal filing—it was a public statement from the head of the company that created ChatGPT. It underscored what legal ethicists have warned for over two years (including TheFormTool, LLC): communications with generative AI tools are not protected.

No legal privilege. No confidentiality. No guaranteed deletion.

The result is clear: attorneys using public AI tools—even for drafting or internal notes—are likely placing sensitive client data at risk of exposure, subpoena, or discovery.

Legal Ethics and Cloud AI: Where the Cloud Falls Short

Confidentiality and data protection are cornerstones of legal practice. These obligations are codified in:

ABA Model Rule 1.6: requires lawyers to preserve the confidentiality of client information.

State Professional Conduct Rules: mirror or extend these duties.

Privacy Laws: such as CCPA, HIPAA, and GDPR, which regulate how data is stored, transferred, and accessed.

Cloud-based AI platforms—whether general (ChatGPT) or legal-specific (e.g., Gavel, Lawyaw)—introduce uncertainty into all of these areas:

    • Data may be stored on third-party or foreign servers
    • Vendors may reserve rights to monitor or audit usage
    • Even opt-out deletion controls may be overridden by court order

These concerns are compounded when vendors add AI features that silently transmit content to cloud processors without the lawyer’s knowledge or meaningful consent.

The False Sense of Privacy in GenAI Tools

Since early 2023, legal commentators have warned that using ChatGPT may breach privilege.

    • March 2024: A loophole in Microsoft Azure’s Open AI abuse monitoring allowed employee access to prompt/response logs.
    • July 2025: A federal judge ordered Open AI to preserve all user logs indefinitely—even those from users who had opted for permanent deletion.

The implication: lawyers who use these tools may be unknowingly creating discoverable content outside their control.
The safer rule of thumb? Treat anything input into a public GenAI tool as if it could appear on a billboard in Times Square.

Privileged Automation is Possible—Offline

Not all automation requires cloud access or third-party servers.

TheFormTool® PRO andDoxserá® are the only leading document automation products confirming a privileged, confidential environment for concerned law firms. Used by thousands of law firms across North America and around the world, they offer robust automation while operating. Unlike their cloud-based competitors—including those that have added generative AI integration—they operate:

    • 100% offline
    • With zero external communication
    • Fully under the user’s control

There are no silent data leaks. No backdoors. No default storage in someone else’s datacenter.

All work product stays where the lawyer puts it: on a local machine, firm network, or virtual private server.

Recommendations for Bars and Ethics Boards

Bar associations and ethics committees can take clear, nonpartisan steps to protect client privilege:

    • Issue formal guidance on the risks of cloud-based GenAI platforms.
    • Encourage or require disclosure to clients if such tools are used.
    • Support offline or local-first tools for privileged work.
    • Provide CLE programming to educate members on AI-related ethics.
    • Develop model disclaimers and engagement letters to address AI usage.
    • Review vendor practices to determine whether cloud AI or remote processing is used in document automation platforms marketed to the legal industry.

These actions can help the legal profession adapt to powerful new technologies without sacrificing its most essential obligations.

TheFormTool® PRO and Doxserá® are the only major document automation programs that operate entirely offline, with no internet connection required and no background communication of any kind. This guarantees that client data never leaves your system.

Security Considerations in Document Automation

Trust is your firm’s most valuable asset.

Clients depend on you to protect their information—and to get every detail right. In today’s digital world, both security and accuracy are essential to maintaining that trust.

This series explores how smarter document automation can help you safeguard client confidence, reduce risk, and deliver better results—without compromise.

Security You Can See and Control

In an era when nearly everything is moving “to the cloud,” it’s easy to forget that the safest place for sensitive information is the environment you control—your own office, your own systems.

Offline document automation keeps you safe by design.

With TheFormTool® PRO and Doxserá®, your documents never leave your custody unless you want them to. There’s no silent upload, no backdoor, and no reliance on a remote server you’ve never seen. You control where your data is stored, who has access, and how it’s protected.

Why does this matter? – There’s no third-party risk. Your data never travels through someone else’s network or data center. No surprise outages or breaches. You’re not dependent on a vendor’s security—or their luck. No external access. If it’s not online, it’s not hackable. It’s as simple as that.

Offline is the gold standard for confidentiality.

While others take their chances with cloud vendors, you can promise your clients something stronger: true data sovereignty and total privacy.

Curious how offline automation keeps your data yours? Your Data, Your Rules: Why Ownership Still Matters in 2025

‘Twas the night before deadlines, when all through the firm
#Santa delivering TheFormTool PRO
‘Twas the night before deadlines, when all through the firm,
Not a paralegal was stirring, no late paperwork churn.
The contracts were hung by the office with care,
In hopes that TheFormTool PRO soon would be there;

The attorneys nestled all snug in their beds,
While visions of seamless documents danced in their heads.
And legal assistants with their briefs in a stack,
Had just settled down from a long day of wrack;

When out on the desk there arose such a clatter,
I sprang from my chair to see what was the matter.
Away to the workstation I flew like a flash,
Tore open the software and threw up the sash.

The glow of the screen on the new-fallen snow,
Gave a lustre of midday to objects below,
When what to my wondering eyes did appear,
But a miniature sleigh and eight tiny rein-deer,

With a little old driver so lively and quick,
I knew in a moment he must be St. Nick.
More rapid than eagles his coursers they came,
And he whistled, and shouted, and called them by name:

“Now, DASHER! now, DANCER! now PRANCER and VIXEN!
On, COMET! on CUPID! on, DONNER and BLITZEN!
To the top of the porch! to the top of the wall!
Now dash away! dash away! dash away all!”

As dry leaves that before the wild hurricane fly,
When they meet with an obstacle, mount to the sky;
So up to the house-top the coursers they flew
With the sleigh full of Tools, and St. Nicholas too—

And then, in a twinkling, I heard on the roof
The prancing and pawing of each little hoof.
As I drew in my head, and was turning around,
Down the chimney St. Nicholas came with a bound.

He was dressed all in fur, from his head to his foot,
And his clothes were all tarnished with ashes and soot;
A bundle of Tools he had flung on his back,
And he looked like a peddler just opening his pack.

His eyes—how they twinkled! his dimples, how merry!
His cheeks were like roses, his nose like a cherry!
His droll little mouth was drawn up like a bow,
And the beard on his chin was as white as the snow;

He spoke not a word, but went straight to his work,
And filled all the stockings; then turned with a jerk,
And laying his finger aside of his nose,
And giving a nod, up the chimney he rose;

He sprang to his sleigh, to his team gave a whistle,
And away they all flew like the down of a thistle.
But I heard him exclaim, ere he drove out of sight—
“Merry Christmas to all, and to all a good night!”

Now every attorney, paralegal, aide,
Can manage their documents, unafraid.
For with TheFormTool PRO comes a sleigh full of cheer,
Perfect workflows and forms, year after year.
Happy gifting to all, and to all a clear sight,
TheFormTool PRO makes all legal work light!

TheFormTool® PRO is the perfect Christmas gift! For just $89 it’s a gift for a lifetime of reduced stress, improved productivity, and perfect accuracy. You can buy all you need in less than two minutes and pass them out before Christmas.

How to Help Brilliant People Shine in Your Firm’s Office

Working in any office, there are hundreds of interruptions to distract you every day. The average worker is sidetracked every 3 minutes from the task at hand and checks emails 30 times an hour. That’s a lot of distraction. Then there’s the time spent looking at cell phones and social media.

This article is about your employees and colleagues, but you might find it applies to you as well.

Distraction and Genius

It doesn’t take a genius to gaze at a cell phone—we all do it. And you don’t need a big IQ to check your emails or to reply to a text message. However, the brains of the smartest, most creative people don’t function in quite the same way as the rest of us.

For people with endlessly inquiring minds every thought or idea leads to another; every question answered poses one more. Their thirst for knowledge, for information, for further detail, can be relentless. Intelligent or creative thought processes are often erratic and restless. Their seeming randomness makes it hard to settle down, and every recovery from distraction seems to take longer.

At the workplace, an inherently wandering mind is difficult to keep on the task at hand. As an employer, the best way to harness their potential is to avoid assigning your brightest workers repetitive tasks.

Intelligent people are quite likely to have a strong work ethic. If you want to get the best out of them, cut out assigning them tasks from the dull pile. Give them more of the challenging, engaging stuff for which they probably joined your team.

The Steelcase Study

In 2016, a study by Steelcase attracted global attention. In addition to its own analysis, the company drew upon the work of neuroscientists and cognitive researchers to reach some interesting conclusions on attentiveness. It identified three key brain modes:

Focus: When the brain needs to focus it must actively avoid distractions like mobile phones or emails.
Regenerate & inspire: Sometimes it’s possible to focus too hard for too long on the same project. Higher quality may result from spending time away from the task and then coming back to it. Distraction can be useful when it is infrequent, turning vice into virtue.
Activate: Studies have shown that exercise stimulates the brain by pumping fresh blood and oxygen through it and releasing hormones. This enhances attention span and memory.

Sensible delegation of tasks, a conducive working environment and careful time management are all crucial aspects of getting the best from employees (and ourselves!) and running an efficient operation.

Demands on Services

In the modern world, the clients of most businesses have become ever more demanding. They want work done quickly and well. This, of course, creates a paradox. It’s rare anyone does their best work in the shortest space of time, but with fierce competition everywhere, we need to work to achieve just that.

One way to deliver work more quickly, without dropping standards, is to automate the most tedious tasks. Not only is this more efficient, it frees up the most talented employees to focus on areas that need deep thought or creativity. Those brilliant, unfulfilled workers, that we’ve already spoken of, will be more fully engaged when challenged with rewarding work. Satisfaction will improve. Productivity will improve. Results will improve.

A Solution: Document Assembly Software

Nobody likes performing repetitive tasks, but the brightest workers are often the worst candidates for doing them well. Great minds wander if there’s nothing compelling to focus on, and that’s where errors creep in.

Great document assembly software offers a way to create repetitive documents without the monotony. It assures accuracy, consistency, compliance, and quality across your company’s paperwork. In lines of work that create vast amounts of paperwork, the best software lends a vital helping hand.

Industries that benefit most from this software include:

Legal
Medical
Insurance
Finance
Government

As well as freeing up the best employees for more challenging and absorbing tasks, document assembly software greatly increases productivity. It needs less personal input and cuts out the time lost correcting mistakes and producing multiple drafts of the same work. Our typical customer reports a 70{9e5c399d4686ffbee71f542e7a95a67178027d042b67cd6e8c3b22a26beb12ba} improvement in throughput and a 100{9e5c399d4686ffbee71f542e7a95a67178027d042b67cd6e8c3b22a26beb12ba} reduction in errors in “A Billion Here…“.

How does Document Assembly Software Work?

Rather than writing documents from scratch or reworking old ones, document assembly software lets companies create document templates that can think for themselves and are usable over and over. There is almost no chance of error.

Once the first document is carefully checked for mistakes, it can be reused repeatedly. All the employee must do is answer a few questions to make every document completely unique, whether ten pages or 1,000. Multiple choice fields can be created to avoid the need for typing. Scores or thousands of variables can auto-complete based on conditions.

Document assembly software should be easily accessible by all employees so there is no time wasted in searching for local documents or by communication breakdowns between staff. Branding stays consistent and up to date, since any changes made to templates are instant and universal. Compliance is a given. Global changes can be made in seconds.

Instead of getting bogged down with hours of writing or editing paperwork, workers can quickly move on to tasks of greater value, tasks they’ll more likely actually enjoy. The more interesting the work is, the less minds tend to drift. Your best workers get a chance to flourish, to add even more to your equation.

Document Automation: Advanced features from TheFormTool

There are many other neat features in software from TheFormTool that save work and valuable time. For instance, if you create similar documents for the same client, you can save then load a full set of previous answers to create the new document in seconds.

Programs from TheFormTool will automatically adjust pronouns, verb forms and syntax to sync with the need.

TheFormTool PRO, Doxserá, and Doxserá DB include math and date calculations. So, for instance, you could enter a monthly fee or loan amount, rate and term, and have the repayment automatically created. Need a date equal to the “Friday after the first Tuesday in a month that is more than 90 days but less than 120 days” in the future? Documents automated by TheFormTool family of products will calculate that date and amount — instantly and automatically corrected should the document be edited.

Aside from handling variables and doing the math, an intelligent form created with our software can rearrange “sections” of itself to change the content order, or automatically add and remove text as necessary. This is useful if the utility or importance of various paragraphs or sections changes over time or according to the client.

Master lists let you keep oft-used data in one handy place for easy retrieval whenever you need it. Doxserá DB allows a form to pull data from external data sources, SQL, Access, Excel, and Outlook Contacts.

Versatility

There are countless uses for document assembly software that works seamlessly with MS Word for Windows and uses the same commands. The learning curve is not steep; you’ll be up and running with the basics in minutes.

Our software enables staff to create professional, attractive documents 70{9e5c399d4686ffbee71f542e7a95a67178027d042b67cd6e8c3b22a26beb12ba} faster on average than they otherwise would. You’ll get more work done at a higher standard and forge a reputation for efficiency.

Not least, you can assign more rewarding work to your talented staff, who will feel like they’re really getting somewhere and that their abilities are being more fully utilized.

Document assembly software disproportionately benefits the smartest people, who need it the most.

Find out how document assembly software makes companies more efficient and frees up the most intelligent workers for more important and challenging work at www.theformtool.com.

Microsoft Word is a huge program seemingly offering something for everyone and every circumstance. It has grown so large, in fact, that we believe it is becoming musclebound, less able to perform basic functions even as its features list grows.

Six months ago we began collecting reports of infrequent and seemingly random failures affecting a few of the largest and most complex forms in use by a handful of our most sophisticated customers. Four months of investigations produced little other than confirmation a problem exists that produces a completely useless runtime error about 10% of the time on a susceptible form.

The Clipboard is the culprit

A user’s casual comment that the problem seemed to happen more often during multitasking, when she was also copying the content of Outlook messages, eventually led us to conclude that Word is unable to consistently keep up with the pace of its own high speed document processing. Simply put, Word’s in-and-out interchanges with the Windows Clipboard can freeze, jamming Word at erratic intervals.

We believe this problem will get worse with time, gradually affecting more and more of Word’s work and the customers around the world who depend on Word for their livelihoods. We wanted a solution, not just for the handfuls of our most sophisticated customers affected today but for all who will be exposed in the future.

Two months of experimentation and repeated false starts through the fall yielded a winning discovery that our amazing technical staff exploited to create a solution that completely removes the Windows Clipboard from use by our programs.

There is a very slight speed increase with the change, but the main advantage is increased program stability and fewer experiences with otherwise unexplainable and apparently unrelated processing interruptions.

We urge all users to update to the newest version of their program, available now. And we congratulate our Technical Operations crew for their tenacity, superb detective work, and crackerjack programming.

Recently, merely keeping up with it all has been a royal chore, with hundreds of features and functions spread across a handful of products, all matched by “how-to” ideas contributed by thousands of customers.

We pride ourselves on producing the easiest to use and most powerful document assembly and automation software in the world. In recent months we’ve turned a bit of that ingenuity and energy toward providing our users with more of the information they need, faster and easier.

We’re creating specific channels of information to inform users of specific changes, such when we release an update, or create a new subject-specific video, or even a “heads up” on upcoming discussion items for the live weekly The Learning Curve podcast.

The main website (www.theformtool.com) will continue to anchor our efforts, ably supplemented with the online Knowledge Base, the amazing online training course (the video version of The Learning Curve), the Word Warrior monthly newsletter (subscribe here), Twitter (@theformtool) and this blog. We’re going to make each of those channels more specific to your interests.

Here are two very specific action items.

You can now receive real time notifications of posts such as this one, or the recent discussions of how to connect Dox DB to MySQL, the very first announcement of Dox DB 2.0, notice of a fix for a troubling bug, and the story of four early adopters of our software. This blog is now publishing RSS feeds in real time that you can access through your news feed or RSS reader just by selecting www.theformtool.com as a feed. If you don’t already have an RSS reader, we suggest you look at feedly.com. Feedly is free and easy. and a great tool. Open an account and then select www.theformtool.com as one of your interests. Check in with feedly as often as you wish to catch summaries of and links to any new items.

If you’d like to be notified as updates become available for your program, subscribe to the article Current Version Numbers of TheFormTool Products, either with an RSS feed or by registering with the Service Center and requesting email updates (by subscribing) to just this one area.

Either way, you’ll be up to date with the latest news of most importance to you, in real time.

And, you’ll learn what more we have in store as its announced in coming weeks.
